10. Time of Making Search
A search warrant must generally be served in the daytime, unless the warrant itself directs that it may be served at any time of the day or night, based on an affidavit asserting that the property is on the person or place to be searched.
11. Validity of Search Warrant
A search warrant is valid for only TEN (10) days from its date; it becomes void after the lapse of that period, and any search conducted thereafter on the strength of the same warrant is invalid.
d. Customs Searches
Customs officials may search vessels, aircraft, and persons/articles for dutiable items without a warrant, pursuant to their police power to enforce customs and tariff laws, given the reduced expectation of privacy at ports of entry.
e. Consented Search
A warrantless search is valid where the person concerned gives VOLUNTARY, unequivocal, specific, and intelligent consent, uncontaminated by any duress or coercion — mere passive/peaceful submission to an assertion of authority is not consent but simply acquiescence to the supremacy of the law.
f. Exigent/Emergency Circumstances
A warrantless search or seizure may be justified by genuine emergency circumstances making it impracticable to first secure a warrant, such as imminent destruction of evidence or immediate danger to life.
g. Search of Vessels and Aircraft
Given their mobility and the practical difficulty of securing a warrant before they depart the jurisdiction, vessels and aircraft may be validly searched without a warrant under circumstances analogous to the moving-vehicle exception.
h. Inspection of Buildings for Fire, Sanitary, and Building Regulations
Routine administrative inspections of buildings and premises to enforce fire, sanitary, and building codes are a valid exercise of police power and do not require a search warrant, being regulatory rather than criminal investigatory in nature.
